Alex Mitchley examines if three appeal court judges based their findings on facts when they acquitted two men previously found guilty of murdering a Coligny teen or was inherent privilege at play. 

The acquittal, by the Supreme Court of Appeal (SCA), of the two white men previously found guilty of murdering a black teenager for allegedly stealing sunflowers has nothing to do with race, but everything to do with a shoddy police investigation, a witness who fabricated, problematic prosecution and a judge who overlooked these elements.

The SCA on Friday overturned the murder conviction of Pieter Doorewaard and Phillip Schutte, who were found guilty of throwing 16-year-old Matlhomola Moshoeu off the back of a moving bakkie in the small town in the North West on 20 April 2017.
