Western Cape Judge President John Hlophe insists the Judicial Service Commission (JSC) "succumbed" to pressure from retired Justice Johan Kriegler and the DA when it "unlawfully" recommended he be suspended.

According to Hlophe, calls by Kriegler, his NGO Freedom Under Law and the DA for him to be suspended by President Cyril Ramaphosa "demonstrate an insidious effort which has been carried out by these individuals and organisations, over time, to usurp the power of the JSC, and possibly other constitutional institutions, with the view to taking control of these institutions".

He argued "this has resulted in a subversion of the rule of law and defeating of the ends of justice".
