The SA Human Rights Commission is taking the EFF, and its leader Julius Malema to the Equality Court over a social media post shared on the party's platforms last year. 

On 14 September 2019, the party shared a video on its Twitter and Facebook pages, paying tribute to the late former Zimbabwean president Robert Mugabe.

The video contained statements which the commission believed constituted various violations of the Promotion of Equality and Prevention of Unfair Discrimination Act 1 of 2000 (the Equality Act).
