While state custodianship continues to be a major stumbling block in amending the Constitution's Section 25, the EFF no longer wants to negotiate with their ANC counterparts on the ad hoc committee working on the amendment but the ANC's top six.

After the EFF threatened with a "much more radical and decisive mechanism if politicians do not want to agree on a simple and straightforward approach", the ANC said it would not be "blackmailed" to obtain a two-thirds majority.

The committee has been deadlocked on the issue of state custodianship for more than three weeks, with the EFF keeping a hard line that it will not support an amendment that doesn't include their proposal that the Constitution should be amended to place all land in state custodianship, which the party argues isn't tantamount to nationalisation.
