Public Protector Busisiwe Mkhwebane's fight for an interdict against President Cyril Ramaphosa and Parliament in connection with her impeachment proceedings is expected to play out in court on Tuesday.

She lost part of an earlier Constitutional Court case where she sought to have the impeachment proceedings dismissed.

The court partially ruled in her favour, saying she was entitled to legal representation during the impeachment process, but it gave the green light for the proceedings to go ahead.

Parliament's Section 194 Committee indicated that the process would go ahead, but Mkhwebane filed a rescission application.

The president wrote to the Public Protector within weeks, asking her to give reasons why she should not be suspended while she was being probed.

Mkhwebane argued that Ramaphosa was conflicted and therefore unable decide whether she should be suspended.
