Looking at judge Mabel Jansen's cases

According to Judge Mabel Jansen, it is my culture to rape because black men believe that a woman is made for a man's pleasure. Crazy enough there are people who still do not see anything wrong with her comments just as Penny Sparrow's comments were the "truth". Every black man is a rapist to her and all blacks are monkeys - less human to Penny Sparrow.

For a person serving as a judge with such racial bias, you would think that black men appearing before her on rape charges are guilty the minute they enter the court. And this is what has people calling for her cases to be reviewed.

The idea sounds great and should probably be done. But the terms of the review should be extended to include rape victims.

When I read her comments, I immediately searched for cases heard by her and looked for harsher sentences against black men accused of rape. To my surprise, she actually let the black man accused of rape go on the first case I looked at. He had been convicted by magistrate but she overturned the guilty verdict and sentence.

She painted the then 15 year old girl who had made the allegation as a  lying whore. She did not use the exact words but if you read the judgement then that's what you would conclude.

I moved on to another one of her recent rape cases. This time she reduced a 20 year sentence  for sexual assault to 10 years. 4 years of the sentence suspended with condition he never rapes again.

On one case she reduced a 15 year sentence to 10 years for a 17 year old who had raped a 5 year old. She said this was because the magistrate had imposed the minimum sentence on the 17 year old which is only permissible in special circumstances. I think her calling the rape a heinous  crime would have perhaps been good enough to invoke that special circumstances power of the court, but she did not.

She loves rapists because they feed her bigotry. She needs them out doing their job so she has something to moan about at her next braai. Something to "support" her claims. Apparently her grandfather was an Apartheid Minister of Native Affairs. Now you know where all that bigotry comes from. It did not die with Verwoerd, nor did it magically disappear in 1994.

So from the few court cases, the black men accused of rape actually got off lightly. Therefore a review of her cases should also include justice for victims and not only focus on the argument that a black man is already guilty when he walks into her court. Important to note that the cases referred to here were first heard by magistrates who found the culprits guilty then Judge Jansen acquitted or reduced sentences.
