I opine that, indeed, the time  is ripe for a mediated solution through the TRC type process to get SA out of the scrum between business/corporate SA and Labour .

I say this because I have followed with great interest the very instructive #ANCLegalWorkshop conducted over the weekend. I agree that we have a exceptionally impartial and independent judiciary as well as strong adherence to the principle of the rule of law.

Investors are concerned at unresolved issues that fester just beneath the radar occasionally erupting into paroxysms of terror in the form of violence and unrest.

My thoughts are that yes, the rule of law entails that human rights be protected and advocated at every level especially in the corporate and business environment.

It is when profits and dividends triumph over human rights that the rule of law is amongst the first casualties.

We saw this at Marikana and during the raft of service delivery unrests across South Africa.

A possible solution to this is for the various chambers of commerce in South Africa,in partnership with government and labour, to convene a TRC type process between business and corporate South Africa on one hand and labour as well as non governmental organisations on the other hand. We need a mediated solution as opposed to a skewed commercial/political one.

The level of poverty exacerbated by unemployment is a worrisome factor that will not be cured by over regulation and taxation without confronting and debating the way out of the quagmire.

Just my thoughts.
