It's taken a long time for the wheels of justice to turn. Ten years – that’s how long Louise Nell has spent trying to get her ex-husband, Andrei Potgieter, to pay her the maintenance he owes her.
In that time their two sons have grown up and started careers of their own and still she’s waiting for him to pay up. And although in 2018 a magistrate’s court sentenced him to six years in jail for being so negligent in his duties to his children, Andrei (57) was out on bail in three months as he launched his appeal.
But now in what’s being hailed as a victory for divorced parents who are struggling to get their partners to pay maintenance, the Gauteng High Court has upheld the original court order, meaning the KwaZulu-Natal businessman is back in jail.
