Halle Berry's ex is reportedly living off the child support she pays.
The 48-year-old actress has daughter Nahla (6) with her former boyfriend Gabriel Aubry, whom she dated between 2005 and 2010.
A highly publicised custody battle ensued after the split, when Halle tried to move their child to France with her now-husband Olivier Martinez. However, in 2012 a judge ordered them to stay in the US as part of her shared custody agreement with Gabriel and she was ordered to pay the $16 000 (R177 000) a month, which adds up to around $200 000 (R2,2 million) a year.
Now TMZ reports Halle has filed legal documents, asking for the amount to be lowered to $3 000 (R33 000) a month. According to the website, she argues that Gabriel is living on the child support money and doesn't work.
The documents apparently claim her ex is "perfectly capable" of getting a job and that money he would earn, plus slashing the amount she pays to him, would give Nahla a more comfortable life.
Currently, Gabriel has the child roughly 50 per cent of time, with Nahla staying at her mother's the rest of the time.
Things famously came to a head in November 2012, amid the aforementioned battle to move their daughter to France. Less than two weeks after the judge denied the request, Gabriel and Olivier were treated in hospital following an altercation.
Olivier was granted a temporary protective order, which prevented Gabriel from coming within 100 yards of him, Halle or Nahla. This was lifted by the end of November and Gabriel was granted a temporary restraining order against Olivier, when the alleged the fight outside Halle's home broke out because Olivier threatened to kill him if he didn't let them take Nahla. Court documents showing severe injuries to Gabriel's face were also leaked and widely spread throughout the media.
On November 29, Halle and Gabriel reached an amicable custody agreement in court and it was in June this year that she was ordered to pay the $16 000 a month.
Halle now also has son Maceo, who was born in 2013, with Olivier.
