Sectional-title living can be rewarding but also presents challenges when residents break the rules. Is the body corporate of my sectional- title complex allowed to impose fines?
The Sectional Title Act makes provision for a body corporate to create rules and a code of conduct for a particular complex. But the rules and code of conduct must be reasonable and apply to all owners of units in the complex.
It’s important to know that the body corporate can only impose fines if these are set out in the rules. For example, the rules must state that you’ll be fined R50 for littering in the garden. The body corporate may not just create rules and issue fines as the occasion arises.
